2024-2025 GTHL Player Registration by Credit Card

You have elected to register your child (the “Child”) as a player in a Greater Toronto Hockey League (“GTHL”) club (the “Club”) for the upcoming GTHL hockey season (the “Season”) through the website located at www.gthlcanada.com (the “Website”). Such registration (the “Registration”) is subject to the following terms and conditions (the “Terms”).

By using the Website to complete the Registration, you hereby accept and agree to be bound by these Terms in regards to such Registration (the “Agreement”).

These Terms contain important information about your rights and obligations, as well as disclaimers, limitations of liability, exclusions of liability and other provisions that may affect your rights and remedies.  Please review these carefully before proceeding with the Registration.

Registration through the Website is to be made for lawful purposes only. To proceed with Registration of a Child as a player for the Club, you must be the parent guardian or legal guardian of the Child and be capable of entering into legally binding agreements.

1.    Website; Account; Other Agreements.

Online registration is made available to you through the account you created on the Website (the “Account”).  You represent and warrant that: (i) you are the Account holder; and (ii) all information you provided when creating your Account, as may have been amended by you from time to time, is accurate, complete and current.

The use of the Website is governed by separate terms of use which may be accessed here (“Terms of Use”) and by GTHL’s online privacy policy which may be accessed here(“Online Privacy Policy”). You hereby confirm that you have read the Terms of Use and Online Privacy Policy. In the event of any conflict between any provision in these Terms and any provision in the Terms of Use, these Terms will govern.

You hereby certify that the information provided about the Child is true, complete and current.  You hereby agree, on your behalf, on behalf of any other parent guardian or legal guardian and on behalf of the Child to be bound by and comply with the rules, regulations and decisions of Hockey Canada, the Ontario Hockey Federation and GTHL which may be restrictive in some areas such as movement from team to team, conduct, and so forth.

2.    Electronic Documents & Transaction

You hereby agree that your completion of a Registration the Website (and your participation in electronic processes that are logically associated with the Registration) constitutes an electronic signature of this Agreement in regards to the Registration and has the same legal effect as if you signed such agreement in ink and will be deemed valid, authentic, enforceable and binding.

You hereby agree that GTHL, its services providers and/or agents may provide to you electronically any communication or notification relating to the Registration, and you hereby consent to receive by electronic means any and all agreements, documents, disclosures and/or notices relevant to the Registration and/or required to be given by applicable law. You also consent to GTHL, its service providers and/or agents responding to any inquiries or communications relating to the Registration by e-mail, fax or other electronic means regardless of the format of the original inquiry. You agree that electronic copies of communications are valid and you will not contest the validity or enforceability of such communications or any related transactions, absent proof of altered data or tampering.

You acknowledge and agree that all electronic communications delivered to you by GTHL, its service providers and/or agents in conjunction with the Registration (i) will have the same legal effect as signed paper communications, (ii) will be considered a “writing” or “in writing” and (iii) will be deemed for all purposes to have been “signed” and to constitute an “original” when printed from electronic files or records established and maintained in the normal course of business. You agree that all electronic communications and actions recorded by GTHL will be deemed valid and admissible originals.

A copy of the Agreement may be retained by you for future reference by clicking here and either printing the document or saving a PDF version of the Agreement on your computer system or mobile device. You confirm that you have sufficient knowledge of the computer system or mobile device used to complete the Registration to print or save a copy of these Terms and other documents relating to the Agreement. A copy of the Agreement will be sent to the e-mail address associated with your Account together with the details of the Registration and completion of the Registration. You are solely responsible for ensuring that the e-mail address currently associated with your Account is valid and accessible to you.

3.    Registration

Before submitting a request for Registration, you will be shown a Registration validation screen which includes the details of the Registration (“Registration Validation Screen”). Please verify the accuracy of such information as it appears in the Registration Validation Screen as once you confirm Registration, the foregoing will constitute a binding offer to complete the Registration as outlined in the registration form at the prices shown in the Order Validation Screen and subject to the taxes and charges shown in the Order Validation Screen.

You may not cancel the Registration after having submitted the registration form through the Website.

Although the registration form made available through the Website may allow you to provide comments relating to the Child or the Registration generally, any purported amendment of these Terms and/or any inclusion of any additional contractual terms and conditions is without effect. Likewise, any attempt to amend or supplement the terms and conditions of these Terms through other means of communications is without effect. In each such situation, these Terms will continue to apply without modification, qualification or exception.

Your request for Registration will be deemed to be accepted only if and when the Website sends a registration confirmation e-mail to the e-mail address associated with your Account (an “Registration Confirmation”).

Notwithstanding the foregoing, acceptance and confirmation of your Registration does not constitute confirmation by GTHL of availability of a place in the Club’s roster or requested player position in terms of the Club’s roster. If it is determined following acceptance of your request for Registration that there is no available room on the Club’s roster, GTHL will notify you by e-mail and promptly provide a refund for the Registration. Acceptance and confirmation of the Registration does not constitute acceptance and confirmation that the Child will play at the position he or she previously played or the position that you may have indicated as desired position. Likewise, acceptance and confirmation of the Registration does not constitute any guarantee of minimum playing time for the Child in regard to the Club and Club games. You acknowledge and understand that the Club has ultimate discretion in terms of player positions, playing time or any other matter regarding the management of the Club.

GTHL reserves the right, in its sole discretion, to limit the number of registration requests for any particular player.

1.    Registration Cancellation

GTHL may, in its sole discretion, refuse or cancel any Registration even after communication of acceptance of such Registration and even after payment for such Registration has been processed. In the event of any such cancellation, Registration shall provide e-mail notification to the e-mail address associated with your Account.

2.    Personal Information

By placing a request for Registration, you consent to the collection and use of personal information about you and the Child, namely the fact that you have submitted a request for Registration, together with the details of the Registration, for the purposes of reviewing the request for registration and completing the Registration as well as for GTHL`s internal accounting, business, marketing and operational purposes. Such personal information will be collected, stored, used, disclosed and retained as described in GTHL`s Online Privacy Policy.

You acknowledge and understand that GTHL has implemented and will continue to implement recording equipment in various arenas where GTHL games are played (“Subject Arenas”) and that games, practices and other events that take place in the Subject Arenas (each, an “Event”) may be recorded. You further acknowledge and understand that such video recordings are intended to be published, distributed and otherwise exploited for commercial purposes by GTHL, Hockey Canada, the Ontario Hockey Federation as well as GTHL clubs (collectively, the “GTHL Group”).

You hereby agree on your behalf, on behalf of any other parent guardian or legal guardian and on behalf of the Child, to grant the GTHL Group, and all licensees, service providers, successors, legal representatives and assigns of the GTHL Group, the absolute and irrevocable right and permission to record the Child in the Subject Arenas, to capture and use his or her voice, image, appearance, likeness and name, and to use, reproduce, edit, modify, distort, adapt, translate, dub, condense, segment, editorialize, create derivative works, exhibit, project, display, publish, broadcast, distribute (including, without limitation, on social media sites, video-sharing websites, content aggregation websites, subscription websites and other internet portals, platforms and websites, by way of webcast, live or on demand video streaming, as well as in regard to all other forms of media and on any other medium, now in existence or which may later come into existence), import, rent, license, sell, commercialize or otherwise exploit throughout the world (collectively, “Use”) photographic pictures, moving pictures, audio-visual recordings and/or video-recorded images of the Child created at or in conjunction with the Event with or without his or her voice, or in which he or she may be included in whole or in part, and any of his or her possessions (collectively, “Recordings”) and, thereafter, to Use the same in all forms and media and on any medium, whether now existing or which may later come into existence, for art, advertising, trade, commercialization, competition of every description and/or any other lawful purpose whatsoever. You hereby acknowledge and agree, on your behalf, on behalf of any other parent guardian or legal guardian and on behalf of the Child, that none of you will have any right, title or interest in any pictures, images or recordings or in any forms or media thereof produced by or for the GTHL, nor will any of you be entitled to any form of remuneration whatsoever with respect to creation of any of the foregoing or any Use of any of the foregoing. You hereby waive, on your own behalf, on behalf of any other parent guardian or other legal guardian and on behalf of the Child, any right that any of you may have to inspect and/or approve the Recordings and/or finished product, any modified version and/or any derivative work thereof and you hereby waive, on your own behalf, on behalf of any other parent guardian or other legal guardian and on behalf of the Child, any right that any of you may have to control the Use of any of the foregoing. You hereby represent and warrant that any other parent guardian or legal guardian has expressly agreed to all of the foregoing. You personally release and forever discharge, on your own behalf, on behalf of any other parent guardian or legal guardian and on behalf of the Child, the GTHL Group, their service providers, licensees, successors, legal representatives, agents and assigns from any liability by virtue of any Use of the Recordings and from liability for violation of any personal or proprietary right that the Child may have in connection with the making of the Recordings and with any Use thereof. You shall indemnify the GTHL Group, their service providers, licensees, successors, legal representatives, agents and assigns with respect to any damages, costs, expenses, liabilities, fines, penalties, or other losses suffered by any of them in regard to any challenge by such child or other parent guardian or legal guardian in regard to the rights conferred to the GTHL Group hereunder and/or the exercise thereof by the GTHL Group.

3.    Prices

Pricing in regards of the Registration is that indicated on the Registration Validation Screen. Please review the foregoing carefully prior to confirming your Registration request. In the event of any discrepancy between the pricing displayed on the Website (including, pricing specified in any Content) and the pricing displayed on the Registration Validation Screen, the pricing displayed on the Registration Validation Screen will apply to the Registration.

All prices on the Website and the Registration Validation Screen are stated in Canadian dollars and do not include applicable provincial and federal sales tax, which will be shown on the Registration Validation Screen and be paid by you together with payment of the underlying Registration fee.

You may be provided with the option to purchase goods or optional services (including, without limitation, insurance) regarding your child’s participation as a player of the Club. If you do so, you will be solely responsible for the costs of such goods or optional services.

4.    Payment Processing

Payment for your Purchase will only be processed through use of a valid VISA, Mastercard or American Express credit card. You represent and warrant that you are the cardholder of the credit card selected for payment of your Order (the credit card used to pay for your order is referred to as the “Credit Card”). Any payment made by credit card is subject to the approval and terms and conditions of the financial institution that has issued the Credit Card.

You acknowledge and understand that the credit card payment for the Registration will be processed using a third party payment processor and GTHL will not come into possession of your Credit Card information.

Any refund in terms of the Registration or other credit in regards to the Registration will be applied to the Credit Card. If the Credit Card is no longer valid or active at the time a refund or credit is processed, a cheque will be issued by GTHL. 

5.    Territorial Restriction

Registration can only be completed in regard to individuals who are residing in Canada at the time of registration.

Any Registration or purported Registration through the Website is void where, at the time your request for Registration is submitted: (i) the child being registered is not a Canadian resident or (ii) you are located in a jurisdiction where submission of the Registration request or use of the Website is prohibited.

6.    Disclaimer

GTHL hereby disclaims any and all representations, warranties and conditions of any sort including, without limitation, any implied warranty or condition of fitness for a particular purpose, merchantability, quality, durability, legally conforming nature, non-infringement, or those arising from a course of dealing, usage or trade in regard to any request for Registration, Registration and/or use of the Website, Content and related services. Without limitation to the generality of the foregoing, GTHL makes no warranty in regards to the accuracy of any pricing, descriptions or other content shown on the Website.

you acknowledge and understand that communications through the internet and other public networks may be intercepted and that electronic communications sent to you in regards to your Order including, without limitation, e-mail confirmations and notifications, may be viewed and/or intercepted by third parties. You accept all such risks and all other risks that are inherent to the use of an electronic platform  and/or electronic communications through a public network.

You acknowledge and confirm that this section 9 constitutes an essential provision of the agreement between you and GTHL and that in the absence of the protection provided to GTHL pursuant to this provision, GTHL would not have provided you with any right or other benefit in regards to the Website, Content, Services and/or Registration.

7.    Limitation of Liability

In no event will GTHL, GTHL clubs, Hockey Canada, the Ontario Hockey Federation, together with their respective, directors, employees, contractors, services providers, agents, advisors, licensors, or other representatives be liable for any indirect, incidental,  consequential or special damages, howsoever caused, including but not limited to: damages for loss of use, work stoppage, lost profits,  failure to realize expected savings, loss of business opportunity, loss of reputation, and depreciation of goodwill, even if GTHL, GTHL clubs, Hockey Canada, the Ontario Hockey Federation, or any of their respective employees, contractors, agents, advisors, licensors or other representatives have been advised of the possibility of such damages or claim. Without limitation to the foregoing (and only in regards to those heads of damages not excluded in this Section 10), GTHL’s maximum liability (as well as that of Hockey Canada, the Ontario Hockey Federation, together with their respective directors, employees, contractors, services providers, agents, licensors, or representatives) in regards to the Registration and everything relating to the Registration  will not exceed the fees actually paid by you for in regard to the Registration.

The foregoing exclusions and limitations will apply notwithstanding any failure of essential purpose of any remedy and are fundamental elements of the bargain between GTHL and you.

You acknowledge and confirm that this section  constitutes an essential provision of the agreement between you and GHTL and that in the absence of the protection provided to GTHL pursuant to this provision, GTHL would not have accept receipt of your request for Registration nor accepted and completed the Registration.

8.    Force Majeure

If GTHL is prevented from completing Registration due to events outside its reasonable control, including but not limited to acts of God, fire, war, strikes, , lock outs, labour controversies, civil unrest, unavailability of public infrastructure, unavailability of public telecommunications networks, war, insurrections or apprehended insurrections, terrorism, quarantines, changes in applicable laws or acts of government, GTHL reserves the right, in sole discretion, to refuse, indefinitely delay or cancel the Registration and provide you a refund in terms of the Registration fees.

9.    Governing Law and Exclusive Courts

GTHL and the servers used to host the Website are physically located in the Province of Ontario, Canada. Any claim relating to Registration or access and/or use of the Website will be governed by the laws of the Province of Ontario without regard to its conflict of law provisions.

In the event of a dispute, you agree to submit to the non-exclusive jurisdiction of the courts located in the city of Toronto, Ontario. You agree to waive any right you may have to: (i) a trial by jury; and (ii) the commencement of or participation in any class action against GTHL related to the Website, the Registration or other matters relating to or flowing from the Registration, you also agree to opt out of any class proceedings against GTHL.

10. Interpretation

The division of these Terms into sections and the insertion of headings are for convenience of reference only and shall not affect the construction or interpretation of these Terms. In these Terms, words importing the singular number include the plural and vice versa; words importing gender include all genders; and words importing persons include individuals, sole proprietors, partnerships, corporations, trusts and unincorporated associations.

11. Entire Agreement

These Terms, as may be amended by the parties, and any and all other legal notices and policies relating to Registration, constitutes the entire agreement between you and GTHL with respect to your request for Registration and any Registration which ensues.

12. Waiver

No waiver of any provision of these Terms shall be binding on GTHL unless executed by GTHL in writing. No waiver of any of the provisions of these Terms will be deemed to be or shall constitute a waiver of any other provision (whether or not similar) nor shall such waiver constitute a continuing waiver unless otherwise expressly provided.

13. Severability

Any provision of these Terms (or portion of a provision) which is held by a court of competent jurisdiction to be illegal, invalid or unenforceable in such jurisdiction will, as to that jurisdiction, be ineffective to the extent of such illegality, invalidity or unenforceability and will otherwise be enforced to the maximum extent permitted by law, all without affecting the remaining provisions (and the remaining enforceable portion of such provision, as the case may be) of these Terms or affecting the legality, validity or enforceability of such provision in any other jurisdiction.

14.Inurement 

These Terms shall inure to the benefit of GTHL and its respective successors and assigns.

15. Refund Policy

We recognize that this is a challenging and uncertain time for everyone, and we are continuing to monitor COVID-19 developments. The GTHL will continue to review conditions and follow all recommendations and guidelines from government agencies and/or our public health partners. 

In the event that the total number of regular season games 28, (26 for U18 and U17 A/AA) and (24 for U21 A) are reduced as a result of a decision by local public heath units or a decision by the Federal, Provincial and/or Municipal government, each player affected by such decision will be refunded a portion of the Player Registration Fee on a pro-rated basis. 

16. Confirmation - Review of Terms

You acknowledge having read these Terms before accepting them, having had the authority to accept these Terms and having had the opportunity to save or print a copy of these Terms.
