STLMH Release

STLMH RELEASE, ASSUMPTION OF RISK & INDEMNITY AGREEMENT 

 

By registering a player with the ST. Laurent Minor Hockey Association (STLMH) you agree to the following conditions of registration. The on-line registration will ask you to accept this "Legal Click-through Agreement" as part of the registration process. Pursuant to the Electronic Commerce and Information Act, this “Legal Click-through Agreement” is legally effective and enforceable as a binding agreement 

 

1. In consideration of the Player and Applicant being permitted to participate in and/or attend the events and activities of STLMH, the Applicant, for him/herself and for the Player, as his/her parent or legal guardian, acknowledges and agrees as follows:

I, the parent or legal guardian of a minor aged player (hereafter will be noted as the applicant), certify the information on the online registration form to be true and consent on behalf of the Player participating in the hockey program of the St. Laurent minor Hockey Association (hereafter will be noted as STLMH). I further agree to abide by and be subject to the constitution, by-laws, regulations, rules, and decisions of the STLMH, the INTERLAKE MINOR HOCKEY ASSOCIATION, HOCKEY MANITOBA and HOCKEY CANADA. I am aware that copies of these rules and regulations are available from the STLMH upon request. 

 

3. Acceptance of Risk: I, the applicant, understand that hockey is a vigorous and physically demanding game in which injuries often occurs. I hereby apply for registration of the player in the programs of the STLMH, and agree to fully accept all risks associated with the Player’s participation in the programs and events of the STLMH, including the risk of serious personal injury. I, the applicant, for myself and on behalf of the Player (as the Player’s parent or legal guardian) and the heirs, executors, administrators and assigns of the applicant and Player, hereby irrevocably releases the STLMH, its officers, directors, coaches, assistant coaches, trainers, managers, referees, officials, servants, agents, and employees from all manner of claims or causes by actions in any way related to personal injury or property damage sustained by the registered player and/or the applicant in the course of participating in, viewing, or traveling to or from any of the games or programs sanctioned by the STLMH. I agree to extend this Waiver to include off-ice activities conducted by the team. These activities include use of gymnasium facilities for dry-land training activities and recreational sports such as floor hockey. Other activities may include team parties and/or road hockey. 

 

4. As a condition of the Player’s participation in the programs, events and activities of STLMH, I, the applicant, agree to indemnify, defend, protect, and hold harmless STLMH, its officers, directors, coaches, assistant coaches, trainers, managers, referees, officials, servants, agents, employees, and assigns (“Indemnitees”) from and against all claims, actions, causes of action, damages, losses, costs, expenses, suits, liabilities, and demands of every nature and kind whatsoever arising out of or in any way connected with the Player’s participation or involvement in any programs, events or activities of STLMH (even if arising from the negligence of the abovementioned Indemnitees) including but not limited to any personal injury, accident, illness, death, or loss or damage of property of the Player or of a third party. The applicant agrees that he/she will defend, at his/her own expense, any such actions, suits, or proceedings brought against the abovementioned Indemnitees for which indemnity might be provided in accordance with the terms of this Agreement 

 

5. I, the applicant, agree to abide by the following conditions of membership as set out by STLMH: 

 

a. The STLMH reserves the right to refuse any person admission into the STLMH without seeking further consent from the applicant or the Player. 

 

b. The STLMH adheres to the age classification system approved by Hockey Canada. The formations of the STLMH teams are based on this classification together with the player selection system. 

 

c. New players must provide the STLMH with a true copy of their birth certificate at the time of registration. 

 

d. Players will, always, on and off the ice, conduct themselves in a sportsmanlike manner, according to the STLMH and HOCKEY CANADA Code of Conduct. Infractions of the rules may result in the imposition of severe penalties, including suspension from further play. 

 

e. All, coaching equipment, sweaters, and goalie equipment issued by the SVMHA are the property of the STLMH. 

 

f. All players in the STLMH must wear a CSA approved type helmet, which fastens under the chin, together with a CSA approved facemask. They must wear protective devices such as athletic supports with cups, shin guards, hockey gloves, neck/throat protectors, shoulder pads, elbow pads, kidney protectors, hockey pants, mouth guard etc. In addition, goaltenders must wear an approved type of facemask, as well as an approved head and throat protector. Insurance provided through Hockey Canada is void if a player's helmet is removed while he/she is on the ice or on the bench. 

 

g. The responsibility for the transportation of players to and from the games or practices rests with the parents, under the direction of the team coach or manager. 

 

h. All registration fees are to be paid no later than January 1, 2024. If full payment is not recieved by January 1, 2024, you will be charged late fees.

 

i. Canteen buy out of $250.00 MUST be paid before October 20, 2023.

 

5. Refund Policy

 

a. Total amount for Manitoba Hockey Membership is Non-refundable. This amount varies per season. If you would like to know the current amount you can find it on the Hockey Maniotba website or contact a member of the STLMH.

 

b. Final date for full refund minus Hockey Manitoba membership amount will be available until the players first regular season game. Refund will not be given after first regular season game.

 

c. Canteen buy out amount is refundable until the players first regular season game. Refund will not be given after first regular season game.

 

6. I, the applicant, acknowledge that a parent or guardian of the Player registered with St. Laurent Minor Hockey must complete the "Respect in Sport for Parents" education as a condition of the hockey player's participation with MHA teams. Failure on my behalf to complete the mandatory program will affect my Player's eligibility to participate in any STLMH activities. 

 

7. I certify that I have read, understood, and declare my agreement with the fore going agreement.
