FFMHA Preseason Safe Return to Sport

The following terms and conditions (these &ldquo;Terms&rdquo;) are an important part of a legally binding and enforceable contract made between the Fort Frances Minor Hockey Association (FFMHA) and the Attendee, including the Parent and Guardian, if any, identified during the registration process online. Information inputted online on HCR 3.0 Hockey Registration (the &ldquo;Website&rdquo;) these Terms together constitute the entire agreement between you and the FFMHA (the &ldquo;Agreement&rdquo;). In this Agreement, the words &ldquo;you&rdquo; and &ldquo;your&rdquo; refer to the Attendee, the Parent and the Guardian, jointly and severally. This Agreement is personal to you and is not transferable or assignable by you without the FFMHA prior written consent.&nbsp;&nbsp;In consideration of your participation in the FFMHA Preseason Camp as further described in Section 1 below, you agree to comply with the terms of this Agreement including paying all fees and charges set out in this Agreement (collectively, the &ldquo;Fees&rdquo;) to the FFMHA.
1. FFMHA Preseason
The preseason program will run as follows:
Anticipated Start Date: The program will commence the week of August 21 , 2023. This is an anticipated start date and may be changed at any time.
End Date: The league will end on September 3, 2023, subject to an extension caused by a delay in commencing on the anticipated start date of August 21, 2023.
Game Format: Safe Return to Sport will consist of nutritional education, dryland training and ice drills. The idea of the camp is to work on overall hockey fundamentals and health (edge work, skating, passing, and shooting and pre-season conditioning) to promote players' safe return to the sport of hockey. &nbsp;
Facility: Fort Frances Memorial Sports Center
2. FEES AND REFUND POLICY
Registration and participation in the Preseason Safe Return to Sport Program is subject to your payment of the following Fees, which are, payable to the FFMHA by e-transfer.&nbsp; Your player will not be considered registered or be able to participate in the program until all fees are paid in full.

Total costs $100 per person (including taxes)
There will be no refunds provided after your registration in the program.
3. SPORTSMANSHIP AND RULES
You agree to conduct yourself in a sportsmanlike manner and strictly comply with the rules establishedby the FFMHA for all sessions. You will conduct yourself in a manner which does not create a nuisance or&nbsp;negatively affect the health or welfare of other players or staff. If you breach this duty, the rules and&nbsp;regulations or provide the FFMHA with false information during the registration process, the FFMHA,&nbsp;may, at its sole discretion, terminate your Agreement with immediate effect and you will not be entitled&nbsp;to any refund of any Fees paid.
4. RISK OF INJURY
Fort Frances Minor Hockey Association Terms &amp;amp; Conditions&nbsp;You acknowledge that there is an inherent risk of injury (both minor and serious) or death associated&nbsp;with participation in the league whether for physical exercise or otherwise. You have considered and&nbsp;voluntarily assume all risk of injury or death relating to your participation in the league and you hereby&nbsp;release and forever discharge and agree to indemnify the FFMHA, its affiliated corporations and their&nbsp;respective directors, officers, employees and agents (collectively the &ldquo;Indemnified Parties&rdquo;) of and from&nbsp;all claims, damages, actions or causes which arise therefrom. You hereby waive all claims that you may&nbsp;have against any one or more of the Indemnified Parties for injury sustained by you as a result of any&nbsp;physical exercises or activities that you undertake in participating in the camp/league, whether or not&nbsp;they are supervised. You agree that this waiver and release is reasonable and proper, particularly given&nbsp;the nature of the FFMHA business.
6. LIMITATION OF LIABILITY
YOU ACKNOWLEDGE AND AGREE THAT THE FFMHA&rsquo;S TOTAL AGGREGATE LIABILITY FROM ANY AND ALL&nbsp;CLAIMS IN CONNECTION WITH THIS AGREEMENT IS LIMITED TO THE TOTAL AMOUNT OF FEES RECEIVED&nbsp;BY THE FFMHA UNDER THIS AGREEMENT. IN NO EVENT SHALL THE FFMHA BE LIABLE FOR ANY: (A)&nbsp;SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, (B) LOST SAVINGS, PROFIT, DATA, USE&nbsp;OR GOODWILL, (C) BUSINESS INTERRUPTION, OR (D) PERSONAL OR PROPERTY DAMAGE, REGARDLESS&nbsp;OF CAUSE OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE, GROSS NEGLIGENCE,&nbsp;FUNDAMENTAL BREACH, BREACH OF A FUNDAMENTAL TERM) OR OTHERWISE. IN NO EVENT SHALL THE&nbsp;FFMHA BE LIABLE TO MITIGATE, INCLUDING FOR PROCUREMENT OR COSTS OF SUBSTITUTE PRODUCTS&nbsp;OR SERVICES.
7. GENERAL TERMS
Entire Agreement. This Agreement constitutes the sole and entire agreement of the parties with respect&nbsp;to the Program and supersede all prior and contemporaneous written or oral understandings,&nbsp;agreements, representations and warranties.&nbsp;Severability; Waiver. Any provision in this Agreement which is prohibited or deemed unenforceable shall&nbsp;be ineffective to the extent of such prohibition or unenforceability without invalidating the remaining&nbsp;provisions of this Agreement. Failure by either party to enforce any right or seek to remedy any breach&nbsp;under this Agreement shall not be construed as a waiver of such rights nor shall a waiver by either party&nbsp;of default in one or more instances be construed as constituting a continuing waiver or as a waiver of&nbsp;any other breach.
Governing Law. This Agreement will be governed under the laws of the Province of Ontario and the&nbsp;federal laws of Canada applicable therein (without reference to conflicts of laws principles). You hereby&nbsp;irrevocably submit to the exclusive jurisdiction of the Courts in Toronto, Ontario with respect to the&nbsp;subject matter of this Agreement.
I/We have carefully read, understand and agree to be absolutely, unconditionally and irrevocably bound by the terms and conditions contained in this Agreement.
