ACKNOWLEDGMENT AND ASSUMPTION OF RISK
I am aware and acknowledge that hockey can be a physical game in which injuries may occur and my participation in ENMHA activities can involve risks. I hereby apply for registration of the player in the activities of ENMHA, agreeing to accept the reasonable risk inherent in the game of hockey including the risk of serious personal injury. The applicant, for himself, herself, themselves, their next of kin, executors, administrators assigns, hereby irrevocably releases the ENMHA, its executive members, directors, coaches, assistant coaches, trainers, managers, referees, officials, and employees from all manner of claims or causes by actions in any way related to personal injury or property damage sustained by the registered player and/or the applicant in the course of participating in, viewing, or traveling to or from any of the games, programs or activities sanctioned by ENMHA. I agree to extend this Waiver to include off-ice activities conducted by the team.

I acknowledge the contagious nature of the COVID-19 virus and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COIVD-19 by attending ENMHA activities. I hereby release and agree to hold ENMHA harmless from, and waive on my behalf, my heirs, and any personal representatives, any and all causes of actions, claims, demands, damages, costs, expenses, and compensation for damage or loss to myself and/or property that may be caused, or that may otherwise arise in any way in connection with any activities related to ENMHA. I understand that this release discharges ENMHA from any liability or claim that I, my heirs, or any personal representatives may have against the ENMHA with respect to any bodily injury, illness, death, medical treatment, or property damage that may arise from, or in connection to, any activities within ENMHA. I hereby accept and consent to the collection, use, and potential disclosure of personal information regarding measures aimed at preventing and mitigating COVID-19 exposure at ENMHA activities.

DISCLOSURE OF PERSONAL DATA
The information collected from the online registration form is strictly used by East Nipissing  Minor Hockey Association for registration purposes.  ENMHA will not share any of the personal data collected through this website with third parties except in some limited circumstances to comply with a legal requirement, for the administration of justice, to protect your vital interest, or in the event of a reorganization, dissolution or similar event.

PARTICIPATION BY MINOR(S)
If I am signing this Agreement on behalf of one or more person(s) who are under the age of 18 years (each, a “Minor”), I confirm the following:
a. I have entered the full legal name and year of birth of each Minor in the requisite fields.
b. I am the parent or legal guardian of each Minor, or otherwise have the necessary legal authority to enter into this Agreement on behalf of each Minor, and hereby accept all the terms and conditions contained in this Agreement on behalf of each Minor.
c. I have assessed the risks and dangers associated with ENMHA activities, having regard to the specific abilities and circumstances of each Minor, and I voluntarily consent to each Minor participating in ENMHA activities, despite such risks and dangers.
d. If any Minor is injured while participating in ENMHA activities, I accept all responsibility and liability for any such injuries and agree to defend, indemnify, and hold harmless the Releasees from all claims or suits for personal injury, property damage or otherwise, which are brought by or on behalf of the Minor, and which are in any way connected with the Minor’s participation in ENMHAA activities.

CONSENT TO USE OF IMAGE AND LIKENESS

I acknowledge that ENMHA may take photographs and/or video recordings of me while I am participating in ENMHA activities. I hereby grant ENMHA express permission to use my name, likeness, image, voice and/or appearance, as such may be embodied in any photographs, video recordings, digital images, and similar media, taken or made by ENMHA. I agree that ENMHA shall have complete ownership of such media, including all copyrights, and may use same for promotional purposes, including on websites or social media accounts maintained by the ENMHA and on physical advertising or informational materials, such as brochures, pamphlets, and articles. I acknowledge that I will not receive any compensation for the use of such media and hereby release ENMHA from all claims which arise out of or are in any way connected with such use.

REFUND POLICY

All refunds will be pro-rated and subject to the non-refundable portion of the NOHA particiapant fee. The NOHA particiapant fee for each participant is $62.00 Refunds can be subject to a $25.00 administration fee (unless under certain circumstances)

• A player through injury cannot complete the playing season
• An U7/Initiation first time player receives approval from the President of ENMHA
• In the event that the season is cancelled through an order of the Ontario Government, Canadian Government, Hockey Canada, OHF, NOHA or any other recognized governing body of the sport.
• In the event, registration fees have been paid and prior to the start of the season, the programming has materially changed (ie shorter season, shift in game play), the athlete may ask for a full refund without the administration fee.
• Once the season has started, the normal refund policy applies.
